Giving a child the opportunity of a permanent loving home through adoption can be one of the most rewarding experiences life has to offer. UK and international child adoption law is complex. Our specialist child adoption lawyers are able to guide you through the process of adoption from providing initial legal advice about the procedure, to representing you in court when the adoption order is sought.

An adoption order grants you

  • legal rights and responsibilities in relation to the child(ren)
  • removes the rights and responsibilities of the birth parents

An adopted child will take your surname and will have the same rights and privileges as if they had been born to you, including the right of inheritance.

Adopting a child from another country is a complex process and depends on whether the country from which the child originates is a signatory to the Hague Adoption Convention. If so, the adoption will be automatically recognised and your child will become a British citizen if you are.

If you are hoping to adopt from a non-Hague Adoption Convention country, you will need to find out whether the adoption is recognised in the UK and if not, you will need to adopt your child here.

An alternative to adoption is to apply for a “Special Guardianship Order” which will give you enhanced parental rights and responsibilities for the child and enable the child to live with you throughout its minority.  You will also be entitled to a special guardian support package which will include practical support and possibly also financial support.
