We have been working for a family-run business in the construction sector for several years. After allegations of serious misconduct by a director and shareholder of over 30 years, we helped it with an urgent investigation and disciplinary process. This involved a disciplinary hearing, and an external HR consultant assisted us with a full rehearing on appeal.

Following the appeal decision to uphold the gross misconduct dismissal, we were then engaged in without prejudice correspondence regarding threatened potential claims against the company by the dismissed director. We strongly refuted the proposed claims, made detailed submissions regarding the limited prospects of any such claims, and issued a costs warning.

We are working with our dispute resolution and corporate teams regarding the forced removal of the director and buy-back of shares. We are also looking at potential litigation to recover sums which were stolen from the company.
