We helped a company which had been badly hit by the pandemic and which saw its income drop by 95% overnight, due to lack of demand prompted by lockdown. The client used the furlough scheme but determined that it had to lose at least around half of its 200 UK staff before 1 August, when employer contributions to furlough began.

We supported the client through the collective consultation process, including election of employee representatives and determination of selection pools and criteria. We also assisted them through the individual consultation stage. The process required us to carefully consider the question of “establishments” and whether employees based in a separate hub could be treated as a separate redundancy pool for collective consultation purposes. We had almost daily calls with the owner and HR manager throughout the 6-8 week process, guiding them from start to finish.
