We helped a married couple who have a son and an autistic daughter. The daughter is under 18 but they were unsure what her needs would be as she grew older. As their estate was substantial they wanted to ensure that it was protected for both children equally.

We advised them on setting up discretionary trusts and the importance of choosing the right trustees to administer the trust as any payments out of the trust would be at the discretion of the trustees. We also advised them on preparing a letter of wishes to sit alongside their Will, although not legally binding it is very useful for the trustees as guidance as to the wishes of the clients when administering the trust.
