We helped an estate agent after they set up another office of their business and employed staff members from a local competitor. The competitor sent a detailed letter before taking action for alleged breach of potentially enforceable post termination restrictions including non-compete (subject to radius).

We gave detailed advice on what activities the employees were permitted to undertake during the restricted period. We disputed the enforceability of one employees non-compete which was unreasonably wide and potentially unenforceable. We negotiated an agreement with the competing agent so that the employee could start work for the agency with immediate effect.
