We helped an IT company with the employment consequences resulting from the dissolution of its subsidiary. The dissolution is part of a wider European restructuring whereby both companies’ functions have been absorbed into the German headquarters due to a cross-border merger.

We advised on the redundancy of the subsidiary’s only employee, which became contentious due to the worker’s claims that his employment transferred under TUPE (Transfer of Undertakings) to the German headquarters. The dispute was resolved by way of confidential settlement, avoiding complex and cross border employment litigation.
