We advised high net worth landlords of a residential property in a wealthy suburb of London in two claims against their tenant under an assured shorthold tenancy (AST).

The AST stated that after the first four months of the 12 month term the landlord could give the tenant no less than two months notice in writing to break the tenancy early. The landlord’s agents served notice and the tenant became liable to pay three months rent, and following non-payment we successfully issued proceedings against the tenant and the rent was paid.

We also dealt with recovery of possession against the tenant on the grounds that the tenancy has been determined under Section 21 Housing Act 1988 by the tenant having been served with two months notice.
